Site Usage Agreement

You agree to be bound by this Agreement by using this site and/or downloading any material. Our agreement applies to you and all of your clients if you are using this website on behalf of a client. We retain the right to modify this agreement at any moment and without giving you prior notice. We reserve the right to _update_ and/or amend our pricing structure as appropriate, including modifications based on our community, images database, or market trends. The most recent version displayed on the site at the time of your use will govern your use of the site. You agree to be bound by these terms by using this site or downloading, uploading, or using any media listed under the Stockphotolk.com domain. If you disagree with anything on this page, please stop using the site and _delete_ any data you have downloaded. If Stockphotolk provides you with a translation of the English language version of a page or site_qt_s functionality, you agree that the translation is given solely for your convenience and that the English language versions of the Terms shall govern your relationship with Stockphotolk. If the English language version and its translation in a foreign language contradict each other, the English language version takes precedence.

Use of this site

Stockphotolk is the owner and operator of this website. Stockphotolk and our Media contributors (Contributors), members of our community, control any Media, audio and video content, and related informative items in any manner given by Stockphotolk hereunder, including related text, captions, or information (collectively referred to as Media). Copyright laws in Sri Lanka and around the world protect all media.

This site contains both visible watermarked media (Watermarked Media) and non-visible watermarked media (Watermarked Media) (Non-Watermarked Media). Watermarked Media can only be searched for, viewed, and used in the ways described here. If you_qt_ve registered for a Stockphotolk account and it_qt_s been approved, you might be able to access Non-Watermarked Media, which you can only use as described below. Stockphotolk maintains the right to cancel your permission to access, download, and use the Media and information on this site at any time, and you agree to cease such usage immediately upon receiving such notice from Stockphotolk. Stockphotolk retains all rights not expressly granted through this Agreement. Furthermore, we do not authorise the usage of automated software or other crawling techniques for searching our website and/or retrieving Media or related information.

If you fail to adhere with any condition of this agreement, Stockphotolk may immediately cancel all licences granted to you without notice. If your licence is cancelled, you agree to stop using this site and the Media immediately, remove all copies of the Media from all media, and destroy all additional copies. All applicable laws must be followed when using this site and any Media. Stockphotolk reserves the right to limit or terminate your access to this site at any time, as well as to limit or terminate your use of any Media for any reason, and to replace the Media with another Media, and you agree to cease all use of the Media immediately upon receiving notice from Stockphotolk.

This site may have technical or other flaws, inaccuracies, or typographical errors despite our best attempts to deliver accurate information. Furthermore, this site and any Media may contain historically and culturally significant Media and text that feature subjects that reflect the social views and conditions of a specific time or area. You should be aware that your search results may include content that is inappropriate for the context or text that is possibly objectionable. You must determine if your use of any Media necessitates the consent of any third party or the licence of any additional rights, and you should not depend exclusively on the information supplied by Stockphotolk or its members. You must consult with competent rights management professionals or legal counsel if you are unsure whether extra third-party rights are required for your use.

Stockphotolk makes a good faith attempt to comply with and resolve all issues relating to potential copyrights and trademarks on the worldwide market. While the Contributor bears sole responsibility for the Media uploaded, as he or she is the one who owns all copyrights to the content provided, we make every effort to detect and resolve any copyright or trademark infringements.

Please contact us if you find a file that reflects such an infringement so that we can take proper action.

Children

Children (those under the age of 18) are not permitted to use this site without adult supervision, and we ask that they do not create an account or provide us with any personal information. You declare that you are 18 years of age or older by accessing this site unsupervised and/or enrolling for an account.

Model and property releases/clearances

With respect to Media for which you have purchased a license through Stockphotolk, the rights that Stockphotolk grant to you do not include a license to any person, place, property, or subject matter depicted in a Media, which may be subject to copyrights, trademarks, rights of publicity, moral rights, property rights or other rights belonging to third parties. Stockphotolk makes no representations or warranties that it owns or licenses any rights nor does Stockphotolk grant you any rights including copyright, trademarks, or rights of publicity belonging to any person, place, property, or subject matter depicted in any Media. Furthermore, Stockphotolk makes no representation or warranty as to the accuracy of any information provided with the Media. You are solely responsible for determining whether your use of any Media requires the consent of any third party or the license of any additional rights, and you should not rely solely on the information provided by Stockphotolk. If you are unsure whether additional rights are needed for your use, you are responsible for obtaining competent legal counsel.

With respect to Media you upload as a Contributor, where such Media depicts one or more individuals, a model release document must be uploaded confirming that the individuals included in your Media have signed a written release. By uploading this document, you certify that the information contained therein is complete and accurate.
With respect to any personal data included on any release document you provide, you acknowledge and agree that you are the data controller or processor, and Stockphotolk is the data processor or sub-processor, as applicable, and accordingly, Stockphotolk agrees that it shall process all personal data in accordance with its Privacy Policy. If you are a data processor, you warrant to Stockphotolk that your instructions and actions with respect to personal data, including your appointment of Stockphotolk as another processor, have been authorized by the relevant controller. Stockphotolk will promptly notify you of any breach of security leading to the accidental or unlawful destruction, loss, _alter_ation, unauthorized disclosure of, or access to, personal data included on any release document you provide.
